- Impersonation: Impersonating any person or entity, including Pequod's Pizza staff, or falsely claiming an affiliation with any person or organization.
- Harassment: Harassing, abusing, threatening, intimidating, or otherwise harming other users or Pequod's Pizza staff.
- Defamatory Content: Submitting false, defamatory, libelous, or fraudulent reviews, comments, or other content through the Site.
- Intellectual Property Infringement: Copying, reproducing, distributing, or creating derivative works from any content on the Site without our express written permission.
- Commercial Exploitation: Using the Site for any unauthorized commercial purpose, including advertising, soliciting business, or reselling our products without written authorization.
- Violation of Law: Using the Site in any manner that violates applicable federal, state, or local laws or regulations of the United States.
Violation of any of the above may result in immediate suspension or termination of your access to the Site, and Pequod's Pizza reserves the right to pursue any legal remedies available under applicable law.

The Pequod's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pequod's Pizza. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for your personal, non-commercial use. This license does not include the right to:
- Sell, resell, or commercially exploit the Content or Site
- Modify or create derivative works based upon the Content
- Reproduce, duplicate, copy, or otherwise exploit the Content for commercial purposes

6. Ordering and Payment Terms
6.1 Order Placement and Acceptance
When you place an order through the Site, you are making an offer to purchase the selected menu items at the stated prices. All orders are subject to acceptance by Pequod's Pizza. We reserve the right to refuse or cancel any order at any time for reasons including but not limited to: unavailability of menu items, inaccuracies in pricing, errors in your order, suspected fraud, or inability to process payment. If your order is canceled after payment has been processed, we will issue a refund using the original payment method.
Order confirmation does not guarantee that all items will be available. In the event that an item becomes unavailable after your order is confirmed, we will notify you and offer a suitable substitute or a partial refund for the unavailable item.
6.2 Pricing
All prices are listed in United States Dollars (USD) and are subject to change without notice. Prices displayed on the Site are exclusive of applicable taxes and delivery fees unless otherwise stated. Taxes will be calculated and added to your total at checkout in accordance with applicable state and local tax laws. Delivery fees, if applicable, will be disclosed prior to order confirmation.
6.3 Payment Methods
We accept payment through the methods listed on the Site at the time of checkout. By providing payment information, you represent and warrant that:

Payment processing is handled by third-party payment processors. Pequod's Pizza does not store your full payment card information on our servers. By using our payment services, you also agree to the terms and conditions of our third-party payment processor(s).
6.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final once an order has been prepared. If you have a concern about the quality, accuracy, or safety of your order, please contact us immediately at [email protected]. Refunds or credits may be issued at our sole discretion on a case-by-case basis. Cancellations must be requested before the order enters the preparation stage to be eligible for a full refund.
7. Delivery and Pickup
Pequod's Pizza offers delivery and/or pickup options subject to availability in your area. Estimated delivery times are approximate and may vary based on order volume, traffic, weather conditions, and other factors beyond our control. We do not guarantee delivery within any specified timeframe. Pequod's Pizza is not liable for delays caused by circumstances beyond our reasonable control.
You are responsible for providing accurate and complete delivery information. If delivery is attempted at the address provided and cannot be completed due to inaccurate information, inaccessibility, or your absence, you may not be entitled to a refund. Risk of loss and title for food items ordered from our Site passes to you upon delivery or pickup, whichever occurs first.
8. Food Allergen and Dietary Information
Pequod's Pizza makes reasonable efforts to provide accurate allergen and dietary information for our menu items. However, our kitchen handles various ingredients that may cause allergic reactions. We cannot guarantee that any menu item is completely free from allergens, including but not limited to gluten, dairy, nuts, eggs, soy, shellfish, or other common allergens, due to shared kitchen equipment and preparation environments.

9.2 No Warranty of Accuracy
PEQUOD'S PIZZA DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE CONTENT ON THE SITE IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE.
9.3 Third-Party Content
The Site may contain links to third-party websites or services that are not owned or controlled by Pequod's Pizza. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to review the terms and privacy policies of any third-party websites you visit. Inclusion of any link to a third-party website does not imply endorsement by Pequod's Pizza.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEQUOD'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Site or our services
- Any unauthorized access to or alteration of your transmissions or data
- Any errors, omissions, or inaccuracies in the content of the Site
- Any bugs, viruses, or other harmful code transmitted through the Site by any third party
- Any food-related illness, allergic reaction, or adverse health event arising from consumption of our products, except to the extent caused by our gross negligence or willful misconduct
- Any delay or failure in performance resulting from causes beyond our reasonable control
IN ANY CASE, PEQUOD'S PIZZA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PEQUOD'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, PEQUOD'S PIZZA'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
11. Indemnification
You agree to defend, indemnify, and hold harmless Pequod's Pizza, its officers, directors, employees, agents, contractors, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Site or services in violation of these Terms
- Your violation of any applicable federal, state, or local law or regulation
- Your violation of any third-party right, including intellectual property rights, privacy rights, or proprietary rights
- Any content or information you submit, post, or transmit through the Site
- Your negligence or willful misconduct
- Any fraudulent, abusive, or illegal activity conducted by you
Pequod's Pizza reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate fully with Pequod's Pizza in asserting any available defenses. You shall not settle any claim without Pequod's Pizza's prior written consent.
12. Governing Law and Jurisdiction
These Terms of Service and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which Pequod's Pizza is registered and operates, without regard to any conflict of law principles.
These Terms are also subject to applicable federal laws of the United States, including the Federal Trade Commission Act (15 U.S.C. § 45) governing unfair or deceptive business practices. To the extent that Pequod's Pizza operates in or serves customers in the State of California, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), may also apply to the collection and processing of personal data of California residents.
Any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the federal or state courts of competent jurisdiction located within the United States, and you hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection you may have to venue or jurisdiction in such courts.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact Pequod's Pizza informally to attempt to resolve the dispute. Please send a written description of your dispute to [email protected]. We will make reasonable efforts to respond within thirty (30) days and work with you in good faith to resolve the matter informally.
13.2 Binding Arbitration
If the dispute cannot be resolved informally within sixty (60) days of your initial written notice, you and Pequod's Pizza agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or equitable relief) arising out of or in connection with these Terms, or the breach thereof, by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding upon both parties.
13.3 Class Action Waiver
YOU AND PEQUOD'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
13.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes that qualify under applicable small claims court rules and procedures, provided the case remains in small claims court and proceeds on an individual (non-class) basis.
13.5 Exceptions
The arbitration agreement set forth above does not apply to disputes relating to: (a) Pequod's Pizza's intellectual property rights; (b) claims involving allegations of fraud or criminal conduct; or (c) emergency injunctive relief where necessary to prevent irreparable harm. In such cases, either party may seek relief in a court of competent jurisdiction.
14. Term and Termination
These Terms shall remain in full force and effect while you use the Site and services. We may, at our sole discretion and without prior notice, suspend or terminate your access to the Site and services for any reason, including but not limited to:
- Breach of any provision of these Terms
- Suspected fraudulent, abusive, or illegal activity
- Providing false or misleading registration information
- Actions that may expose Pequod's Pizza to legal liability or harm to other users
- Failure to pay for orders or engaging in chargebacks without legitimate cause
You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Upon termination of your account, your right to use the Site and services will immediately cease.
The following provisions shall survive any termination of these Terms: Intellectual Property Rights, Payment Terms (with respect to outstanding obligations), Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and all other provisions that by their nature should survive termination.
15. Changes to Terms
Pequod's Pizza reserves the right to modify, amend, or update these Terms of Service at any time at our sole discretion. We will provide notice of material changes by:

16. User-Generated Content

You represent and warrant that you own or control all rights to the User Content you submit, that the User Content is accurate, that use of the User Content you supply does not violate these Terms and will not cause injury to any person or entity, and that you will indemnify Pequod's Pizza for any claims resulting from the User Content you supply.
Pequod's Pizza has the right but not the obligation to monitor and edit or remove any User Content. Pequod's Pizza takes no responsibility and assumes no liability for any User Content posted by you or any third party.
17. Privacy Policy

18. Force Majeure
Pequod's Pizza shall not be liable for any failure or delay in the performance of its obligations under these Terms arising out of or caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government restrictions, civil unrest, labor disputes, internet or telecommunications failures, power outages, supplier failures, or any other event beyond our reasonable control (each, a "Force Majeure Event").
In the event of a Force Majeure Event, Pequod's Pizza shall be excused from performance to the extent affected by such event. We will make reasonable efforts to resume normal operations as quickly as practicable following a Force Majeure Event.
19. Entire Agreement and Severability
19.1 Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or agreements published by Pequod's Pizza on the Site, constitute the entire agreement between you and Pequod's Pizza with respect to your use of the Site and services. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, between the parties with respect to the subject matter herein.
19.2 Severability
If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, such provision shall be deemed severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, and the remaining provisions shall continue in full force and effect.
19.3 Waiver
No waiver by Pequod's Pizza of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Pequod's Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
20. Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without the prior written consent of Pequod's Pizza. Pequod's Pizza may freely assign or transfer these Terms, including all rights and obligations hereunder, without restriction and without notice to you. Any purported assignment in violation of this section shall be null and void. These Terms shall be binding upon and inure to the benefit of each party's permitted successors and assigns.
21. Electronic Communications
By using the Site and providing your email address, you consent to receive electronic communications from Pequod's Pizza, including transactional emails, order confirmations, customer service communications, and, if you opt in, promotional messages. These communications are part of your relationship with us. You acknowledge that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.
